These Terms and Conditions apply to your use of gamesmart.in and to every purchase you make from GAMES MART (“we”, “us”, “our”). By using this website or placing an order, you agree to these terms. Please read them together with our Privacy Policy, Shipping Policy and Return & Refund Policy.

1. Eligibility

You must be at least 18 years old to place an order, or order with the involvement and consent of a parent or guardian. You agree that the information you give us (name, phone number, address, email) is true and complete.

2. Products

  • All products we sell are genuine. Games are physical discs or cartridges unless clearly stated otherwise.
  • Product images are for illustration. Cover art and packaging may differ slightly from the picture.
  • Please check the platform (PS5, PS4, Nintendo Switch) and edition before ordering. A game for one platform will not work on another.
  • Some games need an internet connection, a paid subscription (such as PlayStation Plus or Nintendo Switch Online) or a separate download to use all features. These are not included unless stated.

3. Prices

  • All prices are in Indian Rupees (₹) and include applicable taxes unless stated otherwise. Shipping charges, if any, are shown at checkout before you pay.
  • Prices and offers can change without notice. The price that applies is the one shown when you place your order.
  • If a product is listed at a clearly wrong price because of a technical or typing error, we may cancel the order and give you a full refund.

4. Orders

  • After you place an order, you will receive a confirmation email. This confirms that we have received your order. It does not guarantee that the order will be fulfilled.
  • We may cancel an order if the product is out of stock, the delivery address cannot be served, the payment cannot be verified, or we suspect fraud. If you have already paid, you will receive a full refund.
  • We may limit the quantity of an item that can be bought in a single order.

5. Payment

  • Online payments (UPI, debit and credit cards, net banking and wallets) are processed securely by Razorpay. We do not store your card or UPI details.
  • Cash on Delivery (COD), where offered, is shown at checkout. We may call you to confirm a COD order before dispatch. We may disable COD for customers who refuse COD deliveries.

6. Shipping, returns and refunds

Delivery timelines and charges are explained in our Shipping Policy. Cancellations, returns, replacements and refunds are governed by our Return & Refund Policy.

7. Warranty

  • Consoles and accessories carry the manufacturer’s warranty, where applicable, under the manufacturer’s terms. Warranty service is provided by the brand’s authorised service centres. We will help you with the process.
  • Physical games are covered only against manufacturing defects, as described in our Return & Refund Policy.

8. Your account

If you create an account, you are responsible for keeping your password safe and for all activity under your account. Tell us immediately if you believe your account has been misused.

9. Acceptable use

You agree not to misuse this website. This includes attempting to gain unauthorised access, interfering with its operation, placing fake orders, or posting unlawful, abusive or misleading reviews. We may remove content or suspend accounts that break these rules.

10. Trademarks

PlayStation, PS4 and PS5 are trademarks of Sony Interactive Entertainment. Nintendo Switch is a trademark of Nintendo. All game titles and logos belong to their respective owners. GAMES MART is an independent retailer and is not affiliated with or endorsed by these companies. The GAMES MART name, logo and website content belong to us.

11. Limitation of liability

To the extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect losses, or for delays caused by events beyond our reasonable control, such as courier delays, natural events, strikes or government restrictions.

12. Governing law

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Porbandar, Gujarat. Before going to court, please contact us. Most issues can be resolved quickly.

13. Changes to these terms

We may update these terms from time to time. The version on this page when you place your order applies to that order.
